SIMPL CONTEST - TERMS AND CONDITIONS
These terms and conditions govern your
participation in the Simpl Contest (“Terms and Conditions”) being conducted by One Sigma
Technologies Private Limited
(“Simpl”). By proceeding
with participation in the Simpl Contest, you
hereby acknowledge to have read, understood,
and agreed, on an irrevocable basis, to be
legally bound by the most recent version of
these Terms and Conditions in their entirety
and all other applicable laws and
regulations, without any limitation or
qualification.
The contest is free to participate. Simpl
does not collect any consideration, directly
or indirectly, from Users to participate in
the Simpl Contest. The Simpl Contest is
being conducted with the sole intention to
promote digital transactions in India.
Contest Period
Simpl Users making digital transactions
between 00:00 hours on 1st August, 2023 to
23:59 hours on 31st August, 2023 (“Contest Period”) are eligible to participate in the Simpl
Contest, subject to the terms and conditions
contained herein. The lucky draw will be
held on 10th September, 2023 and the results
will be announced to the winners immediately
thereafter.
Eligibility Criteria
In order to be eligible for Simpl Contest,
you must satisfy the following criteria:

You should be above 18 (eighteen)
years of age;
- You must be a citizen of India;

The residents of the State of Tamil
Nadu are not eligible to participate
in the Simpl Contest in compliance
with the provisions of the Tamil
Nadu Prize Scheme (Prohibition) Act,
1979;

Similarly, Simpl Users in any other
region where a lucky draw or similar
events are prohibited shall not be
entitled to participate in this
contest;
- You must be a Simpl User; and
-
You must not be an employee of Simpl
or a relative of any such employee.
You agree that your failure to comply with
the Terms and Conditions and any other
formalities stipulated by Simpl during the
Contest Period shall disqualify you from
participating in Simpl Contest.
Process of Selection of Winners
The winners of the Simpl Contest will be
selected on a random basis by virtue of a
lucky draw that will be conducted in a fair
and transparent manner on 10th September,
2023. Simpl will announce the names of the
winners on or before 10th September, 2023
via Email/SMS.
Winners will need to provide us with a copy
of their government identity card (i.e.,
Aadhar Card and PAN Card) to confirm their
details and address, and Simpl shall
dispatch their prize to them within 60
(sixty) days of receipt of such details.
If a winner fails to respond to Simpl’s
communication within a period of 7 (seven)
days or are found to be ineligible or not in
compliance with these Terms and Conditions,
the relevant winner will be deemed to have
forfeited his/her right to claim the prize
and consequently the next participant,
chosen by virtue of a lucky draw, will be
eligible to claim the prize. Our
responsibility, therefore, is limited to
informing the winners by email/SMS and on
our social media handles about the prize
that has been won by them, and we shall not
be liable to send any follow-up
communications to winners. In case a winner
does not receive an email/SMS communication
from Simpl regarding confirmation to claim
their prize, it is their responsibility to
inform/ contact us through the number and/or
the e-mail address available on our
Website.
The par/cipants understand and agree that by
merely participating in Simpl Contest, the
participant does not become eligible to
claim the prize(s), and it is necessary for
the participant to be selected and announced
as a winner by Simpl to claim the prizes
mentioned hereinbelow.
Prize Details
The participants who emerge as winners based
on the random lucky draw selection in Simpl
Contest will be entitled to claim the
following prizes:
“Apple Phone- 14”
The income tax or any other statutory tax
liability that arises in connection with the
prize(s) and is applicable from time to time
will be solely borne by the winner(s) of the
respective prize(s).
Limitations of Liability and Release
By participating in Simpl Contest, you agree
and confirm to release Simpl from any and
all claims, damages, or liabilities arising
from or relating to your participation in
Simpl Contest and waive all rights to claim
any punitive, incidental, consequential,
and/ or other damages.
Simpl is not responsible for the quality of
the goods distributed as a prize(s) as these
goods are not manufactured by it, and we
will further not be liable for any damage or
defect to such goods.
Notwithstanding anything contrary contained
herein, Simpl’s total liability in case of
disputes in relation to the Simpl Contest
shall, in all cases, be limited to INR 1,000
(One Thousand Rupees Only).
Intellectual Property
All product names, brands, logos, and
trademarks used in this Simpl Contest, if
any, are property of their respective
owners. Simpl does not own, have, or
exercise any right in relation to the said
third party intellectual property.
Apple does not endorse or sponsor this Simpl
Contest. Apple is not associated with Simpl
and/or this Simpl Contest and is thus not
liable for any aspect in relation to the
Simpl Contest, including but limited to the
prizes distributed by Simpl.
Our Rights
Simpl’s decision with regard to the Simpl
Contest will be final and binding on all
participants. We also reserve the right to
extend or discontinue Simpl Contest or to
cancel, change, amend or modify these Terms
and Conditions including but not limited to
the eligibility criteria, the participation,
selection, and duration clauses, at any time
during the Contest Period, at our sole
discretion, as may be required in view of
any business exigency(ies), or any statutory
or regulatory changes and all such changes
and amendments shall be binding on the
participants.
Governing Law and Jurisdiction
These Terms and Conditions shall be governed
and construed in accordance with the laws of
India and the courts in Bengaluru shall have
exclusive jurisdiction to adjudicate any
dispute arising out of these Terms and
Conditions.
Miscellaneous
Users shall not be entitled to assign any
right contained herein.
If any provision of this Terms and
Conditions shall be invalid or unenforceable
to any extent for any reason including by
reason of any applicable law, the remainder
of the terms contained herein shall not be
affected thereby, and each provision of this
Agreement shall be valid and enforceable to
the fullest extent permitted by applicable
law.
