ONE SIGMA TECHNOLOGIES PRIVATE LIMITED ("Simpl") is concerned about the privacy of its users ("User/You") accessing its website at www.getsimpl.com or accessing the Service through Simpl’s mobile application or our platform services and APIs integrated with our Merchants ("Website") and has provided this privacy policy ("Policy") to familiarise You with the manner in which the technology platform and program provided by Simpl enabling the Users to carry out checkout transaction processing at merchant shop, website and mobile based application (“Service”) and uses and discloses Your information collected for the same through the Website.
Scope of policy
When You register/signup (including signup through third party sign-in services such as Facebook and LinkedIn) with the Website or use the Website or the Service available thereon or link your social media accounts with the Service or your information maintained with our Financial Partners, Simpl may seek and collect certain personal and non-personal information (including information made available through third party sign-in services or your social media accounts), classified as mandatory or voluntary (collectively "Information"). Accordingly, whenever You use, register or signup with the Website or Service, You consent to the collection, use, and disclosure of the Information in accordance with this Policy.
Consent to accept terms of this agreement
By clicking on the tab/button/ checkbox of “Simpl Buy” or “Order with Simpl” or “Simpl Pay in 3” or any other button/checkbox of similar nature, (i) you confirm that eligible under Applicable Law to contract with Simpl, (ii) you consent to conduct transactions, accept the terms and conditions of this Agreement and the Privacy Policy as displayed on the Website and (iii) you consent to receive communications, notices and information from us through post or any other physical medium or electronically (whether through SMS, emails, phone calls and automated phone calls).
Electronic communications shall be deemed to have been received by you when we send the electronic communication to the email address / mobile number / details provided by You or any other third party during the sign-up process as per our records, or when we post the electronic communication on the Website.
Collection & use of personal information
Personal information is data that can be used to uniquely identify or contact a single person. "Personal Information" for the purposes of this Policy shall include, but not be limited to, information regarding Your name, address, telephone number, date of birth, gender, e-mail address, location, any data available on your mobile phone or other devices, proof of identity issued by any governmental authority etc.
The Website may collect Personal Information from You in various ways, including but not limited to, Personal Information provided by You. This includes information provided by You when you use the Service and/or when You register with the Website, create a User Identity also known as User Id, provide information in Your account, search for specific services or content, communicate with Simpl’s customer service by phone, email or otherwise, participate in discussion boards or other community features, provide reviews for the Service available on the Website, or to create an account with Simpl.
As indicated above, some of the Information that Simpl may ask You to provide will be identified as mandatory and some as voluntary. If You do not provide the mandatory Information with respect to the Service, You will not be able to avail of the Service provided by Simpl. Similarly, if You wish to delete Your Information that is mandatory, You will no longer be eligible to avail the Service offered by Simpl or the Website.
Simpl also collects credit information pertaining to You from certain Credit Information Companies. You consent to access of such credit information from Credit Information Companies and agree to the CRIF High Mark Credit Score Terms of Use as set out in Annexure A of the Policy (as amended and updated from time to time).
Simpl collects Personal Information that Simpl believes to be relevant and which is required to understand You and your interests and for the purpose of promoting the Website and the Service. Simpl collects your Personal Information in order to record, support and facilitate your participation in the Service, track your preferences, to provide You with a customized Website experience, to notify You of any updated information and new activities and other related functions offered by Simpl, keep You informed about latest content available on the Website, special offers, and other products and Service of Simpl, to assist You with customer service or technical support issues, to follow up with You after Your visit, to otherwise support Your relationship with Simpl or to prevent fraud and unlawful use.
Simpl does not rent or sell Your Personal Information to other people or non-affiliated companies except to provide the Service. Thus, the Personal Information provided by You is used and shared only:
- to facilitate Your use of the Website;
- for facilitating the Service provided by Simpl;
- to respond to Your inquiries or fulfil Your requests for information about the Service;
- to provide You with information about Simpl’s Service and to send You Information and materials;
- to send You important information regarding the Website and Service, changes to Simpl’s terms, conditions, and policies and/or other administrative information;
- to send You surveys and marketing communications that Simpl believes may be of interest to You;
- to personalize Your experience on the Website and the Service by presenting advertising, products and offers tailored to You;
- to help You address Your problems with the Website and the Service including addressing any technical problems;
- if You avail the Service or use the Website, to complete and complete Your purchase, for example, communicate with You regarding Your purchase and payment due date and provide You with related customer service;
- for proper administering of the Website and the Service;
- to conduct internal reviews and data analysis for the Website (e.g., to determine the number of visitors to specific pages within the Website) and the Service;
- to improve the Service, content and advertising on the Website;
to protect the integrity of the Website and the Service; and - to respond to judicial process and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law.
Information we collect: When You access or use Our Services, We automatically collect information about You, including:
Personal Information: We may collect and process your Personal Information, including but not limited to information provided by you at the time of registration such as your name, address, email ID, phone number, pictures, images, contact details present in the device, etc.
General Log Information: We log information about Your use of the Services, including the type of browser You use, access times, pages viewed, Your IP address, and the page You visited before navigating to Our Services.
Device Information: We collect information about the computer or mobile device You use to access Our Services, including the hardware model, operating system and version, unique device identifiers, and mobile network information.
How we use the information:

- to observe, improve and administer the quality of Services;
- to analyze how the platform is used and diagnose technical problems;
remember the basic information provided by you for effective access; - to confirm your identity in order to determine your eligibility to use the platform and avail the Services
- to notify you about any changes to the Website;
- to enable us to comply with our legal and regulatory obligations;
- for the purpose of sending administrative notices, Service-related alerts and other similar communication with a view to optimizing the efficiency of the Website;

Storage of information
Simpl will use reasonable safeguards to preserve the integrity and security of Your information against loss, theft, unauthorised access, disclosure, reproduction, use or amendment. To achieve the same, Simpl will use reasonable security practices and procedures as mandated under applicable laws for the protection of your information. Information You provide to us may be stored on our secure servers located within or outside India.
You understand and accept that there’s no guarantee that data transmission over the Internet will be completely secure and that any information that you transmit to us is at your own risk. Simpl assumes no liability for any disclosure of information due to errors in transmission, unauthorized third party access to our Website and data bases or other acts of third parties, or acts or omissions beyond our reasonable control and you shall not be entitled to hold the Simpl responsible for any breach of security.
We will hold the information shared by you in the manner described above for as long as we reasonably require for fulfilling the purpose for which we collected such information. This includes for any regulatory, archival purposes, or to protect/defend the Company from any legal claims by anyone.
Disclosure of personal information
Simpl will keep Your Personal Information confidential to the maximum possible extent. Simpl limits the disclosure of Personal Information to Simpl’s employees, independent contractors, affiliates, consultants, business associates, service providers and distributors of Simpl’s Service, on a need-to-know basis, and only if the disclosure will enable that entity to provide Simpl with business, professional, or technical support or to fulfil Your request. Simpl shares Personal Information only for the purposes stated in Clause 2 above and only for to the entities described below.
Your Personal Information may be disclosed:
- to Simpl’s business affiliates and Financial Partners where certain content or Service are jointly offered by Simpl and its business affiliates and Financial Partners; or
- to Simpl’s third party services providers who provide services such as contact information verification, payment processing, order fulfilment, customer service, website hosting, data analysis, marketing assistance, infrastructure provision, IT services, auditing services and other similar services to enable them to provide the services; or
- in case of business transfers such as a merger, acquisition or any form of sale of some or all of Simpl’s assets, Your Personal Information shall be transferred to the other entity as a business asset. Simpl will ensure the confidentiality of any Personal Information involved in such transactions and provide You with a notice before Your Personal Information is transferred and becomes subject to a different privacy policy; or
- as Simpl may believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with any legal processes; (iii) to respond to requests from public and government authorities; (iv) to enforce Simpl’s Terms of Use; (v) to protect Simpl’s operations or those of any of Simpl’s affiliates; (vi) to protect Simpl’s rights, privacy, safety or property, and/or that of Simpl’s affiliates, You or others; and (vii) to allow Simpl to pursue available remedies or limit the damages that Simpl may sustain. This includes disclosing Your Personal Information to other companies and organizations for fraud protection and credit risk reduction; or
- with your specific consent.
The above does not include selling, renting, sharing or otherwise disclosing Personal Information for commercial purposes in violation of the commitments set forth in this Policy.
Collection & use of non-personal information
Non-personal information is any information that does not reveal Your specific identity, such as, browser information, Internet protocol (IP) address, operating system, and platform, information collected through cookies, pixel tags and other technologies, demographic information, time zone setting, etc. ("Non-Personal Information").
As is the case with most websites, the Website gathers some information automatically when You visit the URL of the Website and stores it in log files. Accordingly, when You use the Website and the Service provided on the Website, Simpl may collect certain information about Your computer to facilitate, evaluate and verify Your use of the Website, and the Service available on the Website. For example, Simpl may log environmental variables, such as browser type, operating system, CPU speed, referring or exit webpages, click patterns, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and the Internet Protocol (IP) address of Your computer. This information is generally collected in aggregate form, without identifying any user individually.
The Website may also collect certain Non-Personal Information through cookies while You access the Website. Cookies are text files that are placed in Your computer to identify Your internet browser, store Your preferences, and to improve Your experience on the Website. Data in cookies may be read to authenticate user sessions or provide Service. The Website, online Service, interactive applications, email messages, and advertisements may use cookies and other technologies such as pixel tags and web beacons to help advertisers and publishers serve and manage advertisements across the web and on the Website. Simpl treats Information collected by cookies and other similar technologies as Non-Personal Information.
As Non-Personal Information does not personally identify You, Simpl may use and disclose Non-Personal Information for any purpose. In some instances, Simpl may combine Non-Personal Information with Personal Information (such as combining Your name with Your geographical location). If Simpl combines any Non-Personal Information with Personal Information, the combined information will be treated by Simpl as Personal Information as long as it is combined.
Links to other websites & third party advertisers
The Website may provide third-party advertisements and links to other websites. Simpl does not provide any Personal Information to these third-party websites or advertisers except with your consent.
The links to other websites on the Website are operated by third parties and are not controlled by, or affiliated to, or associated with, Simpl unless expressly specified on the Website. Accordingly, Simpl does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does Simpl control or guarantee the accuracy, integrity, or quality of the information, data, text, software, music, sound, photographs, graphics, videos, messages or other materials available on such websites.
The inclusion or exclusion does not imply any endorsement by Simpl of the website, the website’s provider, or the information on the website. The information provided by You to such third party websites shall be governed in accordance with the privacy policies of such websites and it is recommended that You review the privacy policy on any such websites prior to using such websites.
These third-party websites and advertisers may use technology to send the advertisements that appear on the Website directly to Your browser. In such cases, the third party websites or advertisers automatically receive Your IP address. They may also use cookies, JavaScript, web beacons and other technologies to measure the effectiveness of their advertisements and to personalize advertising content.
Simpl does not have access to or control over cookies or other features that such third party websites and advertisers may use, and the information practices of these third-party websites and advertisers are not covered by this Policy. Please contact them directly for more information about their privacy practices.
Security
Notwithstanding anything contained in this Policy or elsewhere, Simpl shall not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below).
A "Force Majeure Event" shall mean any event that is beyond the reasonable control of Simpl and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, etc.
Access to information
When You use the Website and the Service provided by Simpl on the Website, Simpl makes good faith efforts to provide You with access to Your Information and other relevant data, either to correct this data if it is inaccurate, or to delete such data at Your request, if it is not otherwise required to be retained by law or for legitimate business purposes.
Simpl gives You access to a broad range of Information about Your account and Your interactions with Simpl for the limited purpose of viewing and, in certain cases, updating that information. Such information includes, up-to-date information regarding recent Service accessed by You; Personal Information, payment settings (including credit card information); e-mail notification settings (including Alerts, Recommended for You, and newsletters); utility bill payment details; recommendations (including recent content view history, and favourites); shopping lists; and Your profile (including Your Service reviews, requests, and recommendations, guides, etc.)
User discreation
As stated earlier, You can always choose not to provide Information, even though it might be needed to access the Service. In such cases, if the information required is classified as mandatory, You will not be able to avail of that part of the Service.
You can add or update Your Personal Information on a regular basis. When You update information, Simpl may keep a copy of the prior version for its records.
Simpl may, if You so choose, send direct advertisement mailers to You at the address given by You. You have the option to opt-out of this direct mailer by way of links provided at the bottom of each mailer. We respect Your privacy and if You do not want to receive e-mail or other mail from Simpl, please adjust Your customer communication preferences.
When You use the Website and the Service provided by Simpl on the Website, Simpl makes good faith efforts to provide You with access to Your Information and other relevant data, either to correct this data if it is inaccurate, or to delete such data at Your request, if it is not otherwise required to be retained by law or for legitimate business purposes.

General provisions
By accessing the Website or the Service, You have agreed to the terms set out in this Policy. This Policy should be at all times read along with the User Terms of the Website.
Unless stated otherwise, the Policy applies to all Information that Simpl has about You and Your account.
Simpl may make changes to this Policy, from time to time at Simpl’s sole discretion or on account of changes in law. Simpl will not reduce Your rights under this Policy without Your explicit consent. Simpl may e-mail periodic reminders of the notices and conditions, unless You have instructed Simpl not to, but You should check the Website frequently to see recent changes. Notwithstanding the above, Simpl shall not be required to notify You of any changes made to the Policy. The revised Policy shall be made available on the Website.
The effective date of this Policy, as stated above, indicates the last time this Policy was revised or materially changed. Your continued use of the Website and the Service, following changes to the Policy, will constitute Your acceptance of those changes.

CRIF high mark credit score terms of use
I consent to access my credit information and accept the CRIF High Mark Credit Score Terms of Use as below.
In connection with submission of the application for my credit information ("Consumer Credit Information") offered by CRIF High Mark ("CIC") through One Sigma Technologies Private Limited (referred to as the "Company") and delivery of the Consumer Credit Information to the Company, I hereby acknowledge and agree to the following:
- The Company is my lawfully appointed agent and he / it has agreed to be my agent obtain my Credit Information Report and Credit Score from CRIF High Mark Credit Information Services Pvt. Ltd (CRIF High Mark) for the purpose of hassle-free checkout experience services and not for any other purposes. This consent shall be valid for a maximum period of 6 months or till such time the credit information is required to be retained to satisfy the purpose for which it was intended, or I withdraw my consent to store such credit information, whichever is earlier.
- I hereby expressly grant unconditional consent to, and direct, CIC to deliver and / or transfer my Consumer Credit Information to the Company on my behalf.
- I shall not hold CIC responsible or liable for any loss, claim, liability, or damage of any kind resulting from, arising out of, or in any way related to: (a) delivery of my Consumer Credit Information to the Company; (b) any use, modification or disclosure by the Company of the contents, in whole or in part, of my Consumer Credit Information, wherever authorized by me; (c) any breach of confidentiality or privacy in relation to delivery of my Consumer Credit Information to the Company;
- I acknowledge and accept that: (a) CIC has not made any promises or representations to me in order to induce me to provide my Consumer Credit Information or seek any consent or authorization in this regard; and (b) the implementation of the Agreement between CIC and the Company is solely the responsibility of the Company.
- I agree that I may be required to record my consent / provide instructions electronically or physically as the case may be, and in all such cases I understand that by clicking on the "I Accept" button below or signing this Consent physically, I am providing "written instructions" to Company authorizing Company to obtain my Consumer Credit Information from my personal credit profile from CRIF High Mark. I further authorize Company to obtain such information solely to confirm my identity and display my Consumer Credit Information to me. Further in all such cases by checking this box and clicking on the Authorize button or signing this Consent physically, I agree to the terms and conditions, acknowledge receipt of CIC privacy policy and agree to its terms, and confirm my authorization for Company to obtain my Consumer Credit Information.
- I understand that in order to deliver the product to me, I hereby authorize Company, to obtain my Consumer Credit Information from CIC.
- By submitting this registration form, I understand that I am providing express written instructions for Company to request and receive a copy of my consumer credit report and score from CIC.
- I understand that the product is provided on an “as-is”, “as available” basis and CIC expressly disclaims all warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.
- I shall not sue or otherwise make or present any demand or claim, and I irrevocably, unconditionally and entirely release, waive and forever discharge CIC, its officers, directors, employees, agents, licensees, affiliates, successors and assigns, jointly and individually (hereinafter "Releasee"), from any and all manner of liabilities, claims, demands, losses, claims, suits, costs and expenses (including court costs and reasonable attorney fees) ("Losses"), whatsoever, in law or equity, whether known or unknown, which I ever had, now have, or in the future may have against the Releasee with respect to the submission of my Consumer Credit Information and / or my decision to provide CIC with the authority to deliver my Consumer Credit Information to the Company. I agree to defend, indemnify, and hold harmless the Releasee from and against any and all losses resulting from claims made against CIC by third parties arising from and in connection with this letter.
- I agree that the terms of this confirmation letter shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts located in Mumbai in regard to any dispute arising hereof.
